(1) In order to review the application under Section 49, the Government of Nepal shall form a Public Procurement Review Committee with the following chairman and members:-
(a) Judge of the Court of Appeal or person who has become a judge of the Court of Appeal or one of the persons retired from the post of a specific category of the Government of Nepal - Chairman
(b) One person from among the persons retired from the gazetted first class of the Nepal Engineering Service of the Government of Nepal – Member
(c) One person from among experienced and expert persons in matters related to public procurement – ​​member (2) When appointing a member as per clause (c) of sub-section (1), it is not allowed to appoint an existing employee in a public body.
(3) The term of office of the chairman or member appointed in accordance with sub-section (1) shall be three years. But when appointing members for the first time, one member should be appointed for one year and another member for two years.
(4) The term of office of the chairman or member as per sub-section (1) may be extended for up to one term.
(5) The conditions of service and remuneration and facilities of the chairman or member as per sub-section (1) shall be as prescribed by the Government of Nepal.
(6) The chairman or member according to sub-section (1) shall submit the prescribed information to the Government of Nepal through the Public Procurement Monitoring Office before being reinstated.
(7) The Government of Nepal may remove the chairman or member from his/her post in the following cases:-
(a) In case of misconduct,
(b) Inability to perform the work, duties as per the position due to lack of efficiency or competence, or
(c) If convicted by the court of a criminal offense involving moral turpitude.
